Terms of Service

Email Cheat Code is a product operated by Cuff Technology Solutions, LLC ("us", "we", or "our"). This Terms of Service covers all interactions with the Email Cheat Code service across the EmailCheatCode.com and WatchMyInbox.com domains.

1. Service Description

The Service provides email monitoring and notification services (via SMS and email digest) for your authorized .edu email account. The Service is intended to act as a supplemental notification tool to alert you to critical, time-sensitive emails that may be missed due to email overload.

The Service does not replace, substitute for, or diminish your legal and academic obligation to routinely check your email inbox directly. You remain fully responsible for monitoring your email account and for any consequences arising from missed communications.

2. User Accounts and Eligibility

• Age Restriction: The Service is intended solely for users who are 18 years of age or older. By using the Service, you warrant that you are 18 years of age or older. We do not knowingly permit users under the age of 18 to use the Service.
• Academic Use Only: The Service is provided solely for your personal, non-commercial use related to your enrollment and attendance at a university or college. Use for any purpose that violates academic integrity policies is strictly prohibited.
• Account Credentials: By creating an account, you agree that your login credentials (email and password hash) will be stored to facilitate access to the dashboard.

3. Subscription and Billing (The Payer Model)

• Payer Model: Subscriptions may be purchased by the student or a third-party (the Payer/Subscription Holder).
• Refund Policy:
  • A user is eligible for a full refund if they cancel the Service within 7 calendar daysof the initial subscription payment.
  • After the 7-day period, cancellation prevents all future recurring charges, but no refund will be issued for the remainder of the active billing period. Access to the Service will continue until the end of the paid term.
• Automatic End Date: Subscriptions will automatically end 3 months after the graduation dateprovided upon registration.

4. Termination and Data Deletion

• Subscription vs. Deletion: Canceling a paid subscription or the automatic ending of a subscription is not equivalent to deleting the user account and data.
• Data Deletion Timeline: Student data, including tokens and alert history, is retained for a maximum of 3 months after the user's provided graduation date, after which it is permanently deleted.

5. SMS/Text Messaging Terms

By providing your mobile phone number and opting into our SMS notification service, you consent to receive recurring automated text messages from us related to time-critical email alerts, account notifications, and service updates.

Key Terms:

• Voluntary Consent: Your consent to receive SMS messages is not a condition of purchase or use of the Service. You may use the Service without enabling SMS notifications.
• Message Frequency: Message frequency varies based on your email activity and notification settings. You may receive multiple messages per day during high-activity periods, or no messages for extended periods.
• Message and Data Rates: Message and data rates may apply for any messages sent to you from us and to us from you. Check with your mobile carrier for details on your messaging plan.
• Opt-Out (STOP): You can cancel SMS notifications at any time by replying STOP to any message. You will receive one final confirmation message, after which you will no longer receive SMS messages from us. You may also disable SMS notifications from your account dashboard.
• Opt-In (START): If you have previously opted out, you can opt back in by replying START or by re-enabling notifications in your account settings.

• Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier network availability and other factors outside our control.

6. Disclaimers and Limitation of Liability

Service Provided "As-Is"

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Accuracy

The Service operates on a best-efforts basis and is subject to technical limitations including, but not limited to, email provider API availability, network connectivity, algorithmic filtering accuracy, and third-party service dependencies. The Service may produce false positives (unnecessary alerts) or false negatives (missed alerts).

Third-Party Dependencies

The Service relies on third-party APIs and services including Gmail, Twilio, AWS, and AI providers. We are not liable for failures, outages, or limitations imposed by these third parties, including revocation of API access, service interruptions, or changes to their terms of service.

User Responsibility

You acknowledge that the Service is a supplemental notification tool only and does not replace, substitute for, or diminish your obligation to routinely check your email inbox directly. You remain solely responsible for monitoring your email and for any consequences arising from missed communications, including but not limited to financial, academic, medical, or legal consequences.

Limitation of Liability

In no event shall Cuff Technology Solutions, LLC, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of data, loss of business, financial loss, academic penalties, medical consequences, or the cost of substituted goods or services, even if advised of the possibility of such damages.

Liability Cap

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

Exclusion of Consequential Damages

You acknowledge and agree that we shall not be liable for any financial, academic, medical, or legal consequences resulting from a missed email, delayed alert, or failure of the Service to notify you of a critical communication. This includes, but is not limited to, missed deadlines, late fees, health insurance enrollment issues, registration problems, or any other time-sensitive matters.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Massachusetts, United States.

8. Dispute Resolution

Any disputes arising from or relating to these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. The arbitration shall be conducted in Massachusetts, and each party shall bear its own costs and expenses.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email to the address associated with your account. Your continued use of the Service after such notification constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
